Allgemeine Geschäftsbedingungen des Shou Zhong-Ausbildungszentrums Ost für Klassische Akupunktur und Traditionelle Chinesische Medizin e.V.

  1. Anwendungsbereich

Die Allgemeinen Geschäftsbedingungen (AGB) des Shou Zhong- Ausbildungszentrums Ost für Klassische Akupunktur und Traditionelle Chinesische Medizin e.V. (im Folgenden: Shou Zhong) gelten für alle auf der Homepage veröffentlichten Angebote.

  1. Anmeldung

Die Anmeldung erfolgt schriftlich über ein Anmeldeformular oder über das Online-Formular der Homepage. Zusagen zu den Lehrgängen und Seminaren erfolgen in der Reihenfolge der eingegangenen Anmeldungen. Die Veranstaltungen können nur stattfinden, wenn sich ausreichend Kursteilnehmerinnen oder Kursteilnehmer anmelden. Die Anmeldefrist ist zu beachten. Die Anmeldung wird bestätigt und die Kursteilnehmerin oder der Kursteilnehmer erhält die erforderlichen Informationen wie Veranstaltungsbeginn, Veranstaltungsort und Zahlungsmodalitäten. Gesonderte Vereinbarungen, Abweichungen und Nebenabreden bedürfen der Schriftform.

  1. Stornierung

Der Rücktritt vom Vertrag ist nur schriftlich möglich. Bei Stornierung entstehen folgende Bearbeitungsgebühren:

bis spätestens 6 Wochen vor Beginn des Seminars: keine Gebühr

bis spätestens 28 Tage vor Seminarbeginn 25 % der Teilnahmegebühr

bis spätestens 14 Tage vor Seminarbeginn: 50 % der Teilnahmegebühr

ab 14 Tage vor Seminarbeginn und Nichterscheinen: die volle ausgewiesene Teilnahmegebühr

Die Stornogebühr entfällt, wenn von der Kursteilnehmerin oder dem Kursteilnehmer eine der Zielgruppe entsprechende Ersatzperson nominiert wird, die die Veranstaltung besucht und die Teilnahmegebühr leistet.
Maßgeblich für den Zeitpunkt ist der Zugang der Stornierung im Sekretariat von Shou Zhong.
Gesetzliche Bestimmungen zur außerordentlichen Kündigung bleiben unberührt.

  1. Änderungen im Veranstaltungsprogramm / Veranstaltungsabsage

Aufgrund der langfristigen Planung sind organisatorisch bedingte Programmänderungen möglich. Shou Zhong behält sich das Recht vor, Veranstaltungen bei zu geringer Teilnehmendenzahl oder bei kurzfristigem Veranstaltungsausfall durch höhere Gewalt, Krankheit oder Unfall der Dozentin oder des Dozenten, sowie durch sonstige von Shou Zhong nicht zu vertretende Umstände entweder durch eine andere qualifizierte Dozentin oder einen anderen qualifizierten Dozenten durchführen zu lassen, einen neuen Veranstaltungstermin zu benennen oder die Veranstaltung (auch kurzfristig) abzusagen. Ggf. informiert Shou Zhong die Kursteilnehmerin oder den Kursteilnehmer umgehend schriftlich oder telefonisch. Weitergehende Schadenersatzansprüche sind ausgeschlossen. Im Falle der endgültigen Absage der Veranstaltung erstattet Shou Zhong die Teilnahmegebühr. Betrifft die Terminverschiebung oder der Umbesetzung der Dozentin oder des Dozenten ein einzelnes, in sich abgeschlossenes, Weiterbildungswochenende, besteht seitens des Kursteilnehmers oder der Kursteilnehmerin ein Rücktrittsrecht mit Rückvergütung der Kursgebühren.

  1. Haftung

Für Schäden am Eigentum oder an der Gesundheit der Kursteilnehmerin oder des Kursteilnehmers bei Anfahrt oder Rückreise sowie während des Seminars übernimmt Shou Zhong keine Haftung. Ebenfalls keine Haftung übernimmt Shou Zhong für die Art der Umsetzung der im Seminar erworbenen Kenntnisse.
Sollte durch das Verhalten einer Kursteilnehmerin oder eines Kursteilnehmers der Erfolg einer Veranstaltung gefährdet werden, behält Shou Zhong sich vor, den Kursteilnehmer oder die Kursteilnehmerin nach sorgfältiger Prüfung der Sachlage von der weiteren Veranstaltung auszuschließen. Ansprüche können anschließend nicht geltend gemacht werden.

Bei einer eventuellen probatorischen Behandlung im Rahmen der Fortbildung durch andere Kursteilnehmer oder Kursteilnehmerinnen oder durch Kurs- und Übungsleiter oder Übungsleiterinnen handeln Kursteilenehmerinnen und die Kursteilnehmer ausschließlich auf eigene Gefahr. Ersatzansprüche sind ausgeschlossen. Hinsichtlich geringfügiger Änderungen der angekündigten Seminarinhalte durch die Dozentin oder den Dozenten übernimmt Shou Zhong keine Haftung.

  1. Schweigepflicht

Die Kursteilnehmerin oder der Kursteilnehmer ist verpflichtet hinsichtlich sämtlicher Informationen, die er oder sie über Patientinnen oder Patienten bzw. Mitschülerinnen oder Mitschüler, die sich für Lehrzwecke als Patient oder Patientin zur Verfügung gestellt haben, erhalten hat, Stillschweigen zu bewahren.

  1. Allgemeine Informationen

Schulungsmedien, die während der Fortbildungsveranstaltungen an die Kursteilnehmerinnen oder Kursteilnehmer ausgehändigt werden, sind Arbeitsunterlagen für den Kursgebrauch. Sie sind urheberrechtlich geschützt und dürfen weder vervielfältigt noch für eine eigene Lehrtätigkeit benutzt werden. Ton- und Videoaufnahmen sind im Unterricht nicht gestattet. Missbrauch wird strafrechtlich verfolgt. In der Seminargebühr sind die Arbeitsunterlagen enthalten.

  1. Datenschutz

Die Shou Zhong übermittelten Daten werden in der eigenen EDV von Shou Zhong erfasst und nur zu internen Zwecken von Shou Zhong, der Arbeitsgemeinschaft für Klassische Akupunktur und TCM e.V. (AGTCM) und des „Bundes Deutscher Heilpraktiker e.V.“(BDH) genutzt. Die Daten werden ansonsten nicht an Dritte weitergegeben.
Die Kursteilnehmerin oder der Kursteilnehmer kann auf Antrag Auskunft über die gespeicherten Daten erhalten sowie deren Berichtigung und Löschung oder Sperrung verlangen. Weitere Details kann die Kursteilnehmerin oder der Kursteilnehmer in der Datenschutzerklärung von Shou Zhong einsehen.

  1. Foto- und Filmrechte

Im Rahmen der Veranstaltungen von Shou Zhong werden Fotografien, Film- und Videoaufnahmen vom Kursgeschehen und von Kursteilnehmerinnen und Kursteilnehmern angefertigt. Die Aufnahmen werden unter Berücksichtigung des Kunsturhebergesetzes (Recht am eigenen Bild) in Medien-Veröffentlichungen und für die Eigenwerbung von Shou Zhong verwendet.
Mit der Teilnahme an einer Veranstaltung bei Shou Zhong erklärt der Kurseilnehmer oder die Kursteilnehmerin sein bzw. ihr Einverständnis zur Aufnahme, Verbreitung und Verwertung des von Shou Zhong angefertigten Foto-, Film- und Videomaterials in Publikationen zur Eigenwerbung und im Internet.

  1. Nebenabreden

Mündliche Nebenabreden bestehen nicht. Jede Änderung und Ergänzung dieses Vertrages bedarf der Schriftform. Auf dieses Formerfordernis kann nur durch schriftliche Erklärung verzichtet werden.

  1. Salvatorische Klausel

Im Falle der Unwirksamkeit einer oder mehrerer Bestimmungen dieser AGB beeinträchtigt dies deren Wirksamkeit im Übrigen nicht. Im Falle der Unwirksamkeit einer oder mehrerer Bestimmungen tritt an deren Stelle eine Bestimmung, die dem Rechtsgedanken der unwirksamen Bestimmung am nächsten kommt.

  1. Anwendbares Recht, Gerichtsstand, Inkrafttreten

Für die vertraglichen Beziehungen gilt ausschließlich deutsches Recht. Der Gerichtsstand ist Berlin.

General Terms and Conditions

General Terms and Conditions of the Shou Zhong-Ausbildungszentrums Ost für Klassische Akupunktur und Traditionelle Chinesische Medizin e.V.

  1. Scope of application

The General Terms and Conditions (GTC) of the Shou Zhong-Ausbildungszentrums Ost für Klassische Akupunktur und Traditionelle Chinesische Medizin e.V. (hereinafter: Shou Zhong) apply to all offers published on the homepage.

  1. Registration

Registration is done in writing via a registration form or via the online form on the homepage. Acceptances to courses and seminars will be made in the order in which registrations are received. Courses can only take place if a sufficient number of course participants register. The registration deadline must be observed. Registration will be confirmed and the course participant will receive the necessary information, such as the start of the course, venue, and payment modalities. Separate agreements, deviations, and subsidiary agreements must be made in writing.

  1. Cancellation

Cancellation of the contract is only possible in writing. In the case of cancellation, the following processing fees will be charged:

  • no later than 6 weeks before the start of the seminar: no fee
  • no later than 28 days before the start of the seminar: 25 % of the participation fee
  • no later than 14 days before the start of the seminar at the latest: 50 % of the participation fee
  • as of 14 days or more before the start of the seminar and non-attendance: the full participation fee shown

The cancellation fee is waived if the course participant nominates a replacement who corresponds to the target group, attends the course, and pays the participation fee.

The date of receipt of the cancellation at the Shou Zhong office shall determine the date of cancellation.

Legal provisions for extraordinary cancellation remain unaffected.

  1. Changes in the program / cancellation

Due to long-term planning, changes in the program are possible for organizational reasons. Shou Zhong reserves the right to cancel a course due to force majeure, in the event that the instructor is ill or has been in an accident, or other circumstances beyond Shou Zhong’s control. Shou Zhong reserves the right to have the course held by another qualified instructor, to set a new course date, or to cancel the course (even at short notice) if the number of participants is too low or if the course is cancelled at short notice due to force majeure or in the event that the instructor is ill or has been in an accident. If necessary, Shou Zhong will inform the course participant immediately in writing or by telephone. Further claims for damages are excluded. In the event of a final cancellation of the course Shou Zhong will refund the participation fee. If the postponement or the change of instructor concerns a single, self-contained training weekend, the course participant has the right to cancel the course and receive a refund of the course fees.

  1. Liability

Shou Zhong assumes no liability for damage to the property or health of the course participant during the journey to or from the seminar as well as during the seminar. Likewise, Shou Zhong assumes no liability for the manner of implementation of the knowledge acquired in the seminar.

Should the behavior of a course participant endanger the success of a course, Shou Zhong reserves the right to exclude the course participant from the rest of the course after careful examination of the facts. Claims cannot be asserted afterwards.

In the case of potential probationary treatment by other course participants or course instructors in the context of a training, course participants and course instructors act exclusively at their own risk. Claims for compensation are excluded. Shou Zhong assumes no liability for minor changes to the announced seminar content by the instructor.

  1. Duty of confidentiality

The course participant is obliged to maintain confidentiality with regard to all information he or she has received about patients or fellow students who have volunteered as patients for teaching purposes.

  1. General information

Educational material handed out to course participants during training sessions are working documents for use in the course. They are protected by copyright and may not be reproduced or used for teaching purposes. Sound and video recordings are not permitted in class. Misuse will be prosecuted. The seminar fee includes the working documents.

  1. Data protection

Data transmitted to Shou Zhong will be recorded by Shou Zhong’s own EDP and will only be used for purposes internal to Shou Zhong, the Arbeitsgemeinschaft für Klassische Akupunktur und TCM e.V. (AGTCM), and the Bundes Deutscher Heilpraktiker e.V. (BDH). The data will otherwise not be passed on to third parties.

Upon request, the course participant can receive information about the stored data and request their correction and deletion or blocking. Further details can be found in Shou Zhong’s privacy policy.

  1. Photo and film rights

In the context of Shou Zhong training activities, photographs are taken and film and video recordings are made of course activities and course participants. The photos and recordings will be used in media publications and for Shou Zhong’s own advertising, in compliance with the German Artistic Copyright Act (right to one’s own image, KUG).

Upon participation in a course at Shou Zhong, the course participant declares his or her consent to the recording, distribution, and utilization of the photo, film, and video material made by Shou Zhong in publications for house advertising and on the Internet.

  1. Collateral agreements

There are no collateral verbal agreements. Any amendment or supplement to this contract must be made in writing. This formal requirement can only be waived by written declaration.

  1. Severability clause

In the event that one or more provisions of these GTC are invalid, this shall not affect the validity of the remaining provisions. In the event that one or more provisions are invalid, they shall be replaced by a provision that comes closest to the legal intent of the invalid provision.

  1. Applicable Law, Place of Jurisdiction, Entry into Force

All contractual relations shall be governed exclusively by German law. The place of jurisdiction is Berlin.

These GTC are valid from 01 February 2021.
