Terms and Conditions

Terms and conditions of the Ausbildungszentrums Ost für Klassische Akupunktur und Traditionelle Chinesische Medizin e.V (Training Centre East of Classical Acupuncture and Traditional Chinese Medicine, Registered Association)

1. Area of Application

The General Terms and Conditions (GTC) of the Ausbildungszentrums Ost für Klassische Akupunktur und Traditionelle Chinesische Medizin e.V (ABZ-Ost) apply to all published courses and seminars offered.

2. Registration

Registration is made in writing on the registration form or via the online form of our Homepage. Course or seminar acceptance will be based on the order of applications received. Courses can only take place when enough participants register, please note the registration deadline. Registration will be confirmed and the course participant will then receive all necessary information such as the event schedule, venue details, and terms of payment. This, together with proof of payment in the bank account statement, will be valid for tax purposes. Separate agreements, deviations and ancillary agreements must be made in writing.

3. Cancellation

Withdrawal from the contract is only possible in writing. Please note that we charge the following processing fees for cancellations:

  • at least 4 weeks prior to the seminar: no fee
  • at least 14 days prior to the seminar: 25% of the attendance fee
  • less than 14 days prior to the seminar and nonattendance: the full designated participation fee

The cancellation fee does not apply if a suitable replacement is provided who attends the event and pays the appropriate registration fees.

The cancellation date is calculated from the date it is received by our office.

4. Changes in the event programme / event cancellation

Due to the necessity of long-term planning, organizational related programme changes are possible. We reserve the right to cancel, reschedule events, or find a suitably qualified replacement lecturer at short notice in the case of too few participants, or in the case of the lecturer's absence owing to illness or accident or due to force majeure or other circumstances or events beyond the control of ABZ-Ost. We will inform you immediately by telephone or in writing. Any other compensation claims are excluded. In the case of the final cancellation of the event, we will refund the registration fee. The course participant has a right of withdrawal with reimbursement of course fees if the replacement lecturer or new course date is unsuitable. Please note that this applies only for self-contained weekend courses.

5. Liability

We accept no liability for damages to the property or health of the course participants on the journey to or from the seminar. We accept no liability for implementation of knowledge acquired in the seminar. We reserve the right to exclude course participants from any event due to any threatening or disruptive behaviour, after careful examination of the situation. Claims cannot be asserted subsequently.

Course participants act at their own risk with regard to any possible probatory treatment under training by other course participants and/or the instructor. Any compensation claims are excluded. The ABZ-Ost assumes no liability with regard to minor amendments to the content announced by the lecturer.

6. Professional Discretion

The course participants undertake to maintain confidentiality with regard to all information received about patient/patients or fellow students during the course or seminar.

7. General Information

Training media handed out to the course participants during the training sessions are working documents for use during the course. They are copyrighted and may not be reproduced or used for any other personal teaching activities. Sound and video recordings are not allowed in the classroom. Examples of misuse will be prosecuted. Working documents are included in the seminar fee.

8. Data Protection

All data provided to us is recorded and used only for internal purposes by the ABZ-Ost and the Arbeitsgemeinschaft für Klassische Akupunktur und TCM e.V.

9. Subsidiary agreements

Verbal subsidiary agreements do not exist. Any contract changes and supplements must be made in writing. This formal requirement can only be waived in writing.

10. Severability Clause

In the event that one or more provisions of this contract should become invalid, the rest of the contract remains in force. In this case a provision will be made which is closest to the legal principle.

Applicable Law, Jurisdiction, Coming into Effect

German law applies exclusively to the contractual relationship. The place of jurisdiction is Berlin.

These terms and conditions are effective from 31st November, 2004 / as of 31st May, 2009
